IV. ONLINE SALES POLICY

Any Client/Buyer may access the website in order to place an Order.

For justified reasons, the Seller reserves the right to restrict the Client's/Buyer's access to placing an Order and/or to some of the accepted payment methods if it considers that, based on the Client's/Buyer's conduct or activity on the Website, their actions could harm DTM GOES ONLINE SRL in any way. In any such case, the Client/Buyer may contact our Customer Relations Department to be informed of the reasons that led to these measures.

While using the website and its services, you, as a User, undertake:

DTM GOES ONLINE SRL may publish on the Website information about the digital products and/or services and/or promotions offered by it or by any third party with which DTM GOES ONLINE SRL has partnership agreements, for a given period of time. Digital products are available without stock limits.

All prices for the products shown on the Website are expressed in lei (RON) and include VAT.

The prices shown on the website for digital products are final prices, including VAT. Digital products are not subject to the green stamp duty or other charges specific to physical goods.

For online payments, the Seller is not and cannot be responsible for any other additional costs borne by the Buyer, including but not limited to currency conversion fees charged by the bank that issued their card, where the card's currency differs from RON. The Buyer alone is responsible for this.

All information used to describe the digital Products and/or Services available on the Website (still/moving images, multimedia presentations, etc.) does not constitute a contractual obligation on the part of the Seller and is used solely for presentation purposes.

V. ASSIGNMENT AND SUBCONTRACTING

The Seller may assign and/or subcontract to a third party Services related to fulfilling the Order, informing the Buyer, without needing the Buyer's consent.

VI. ORDERING ON THE WEBSITE

Ordering Products

To place an order, the User (Buyer) adds the desired products to the shopping cart by selecting the “Add to cart” button or a similar one. The shopping cart shows the list of selected products (the “View cart” button), and the User can update the quantity or remove one, several or all of the selected products.

All digital products sold on the website are permanently available for purchase, without stock limits. Adding a Product/Service to My cart without completing the Order does not register that Order.

Billing details

The price, payment method and payment term are specified on the Website and in each Order and include VAT and other applicable taxes. The Seller will issue the Buyer an invoice for the Products and Services delivered; the Buyer must provide all the information needed to issue the invoice in accordance with the law in force.

The Seller will send the Buyer the invoice for an Order containing digital Products and/or Services, as well as for any other payments related to the Order, in the client Account and/or by email, as required by law (including RO e-Factura). Invoices are sent in electronic format only.

To ensure the invoice for the Order is communicated correctly, the Buyer must update the data in their Account whenever necessary and access the information and documents for each Order available in the Account.

The ordering process

  • After adding the desired products to the cart, press the “Checkout” button
  • Fill in the billing details (if not already filled in)
  • Proceed to payment

Digital products do not require choosing a delivery method; they are provided automatically by email after payment.

The final step in sending the order is the “Place order” or “Go to payment” button. Shortly after pressing it, you will receive an email confirming that the order has been registered.

Cancelling an order

The Seller may cancel the Order placed by the Buyer, after prior notice sent to the Buyer by email, without any further obligation of either party towards the other and without either party being able to claim damages from the other, if:

• The Client provided incomplete, untrue or incorrect data

• The digital Products and/or Services were displayed on the Website as a result of technical errors

• Obviously wrong/derisory prices resulted from technical errors

In the event of cancellation, the full amount paid by the Buyer is refunded within 14 (fourteen) calendar days (under Art. 13 of Government Emergency Ordinance no. 34/2014).

Digital products involve no delivery costs, as they are provided electronically by email.

Payment method

The only payment method accepted on the website is payment by bank card (debit or credit). Bank transfer, cash on delivery and other payment methods are not accepted.

The card's confidential data (card number, holder, expiry date, security code) is encrypted and transmitted securely to the payment processor. The Seller never has access to and does not store the details of the card the Client uses to pay for the Products.

After the payment, the Buyer automatically receives by email the access or download links for the digital products purchased.

Delivery of digital products

The digital products sold on the website are delivered exclusively in electronic format. Immediately after the payment is confirmed, the Buyer receives by email, at the address given in the Order, the access or download links for the digital products purchased.

The Seller is not responsible if the digital products cannot be accessed because the Buyer provided an incorrect or incomplete email address.

Note

If the Buyer does not receive the confirmation email with the access links within 24 hours of the payment, they are asked to check their spam/junk folder and to contact the Seller at the email address shown on the website.

Availability of download links

The download links sent by email remain permanently active. If the Buyer loses access to them (email deleted, technical problems, etc.), they can ask for the links to be resent by contacting the Seller at hi@danblocks.com and providing the order's identification details.

VII. THE RIGHT OF WITHDRAWAL FOR DIGITAL PRODUCTS

The nature of digital products and the right of withdrawal

The website www.danblocks.com sells exclusively digital products (digital content supplied on an intangible medium), such as:

  • Templates
  • Guides
  • Online courses
  • Digital resources and other similar materials

Legal basis

Under Art. 16(m) of Government Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals, transposing Directive 2011/83/EU, the right of withdrawal does not apply to the supply of digital content not delivered on a tangible medium, if performance has begun with the consumer's prior express consent and after the consumer has acknowledged that they will thereby lose the right of withdrawal.

The Buyer's consent and acknowledgement

By completing the Order and paying for a digital product, the Buyer:

  • (a) gives express consent to the immediate supply of the digital content, namely the sending of the access or download links by email
  • (b) acknowledges and accepts that they lose the right of withdrawal from the moment they receive access to the digital product (by the email containing the access or download links)

Loss of the right of withdrawal

The right of withdrawal is lost when the Buyer receives the confirmation email containing the access or download links for the digital products purchased, since the supply of the digital content has begun with their express consent.

Consequently, once the digital product has been delivered electronically (by sending the access or download links), the Buyer can no longer request a refund of the amount paid on the basis of the right of withdrawal provided by Government Emergency Ordinance no. 34/2014.

Exceptions - Technical defects

If the digital product has technical defects that make it unusable (non-working download links, corrupt files, content missing or incomplete compared with the description on the website), the Buyer is entitled to request:

  • (a) the defect to be remedied by providing a working download link or the correct content
  • (b) replacement with an equivalent digital product, if remedying is not possible
  • (c) a full refund of the amount paid, if neither remedy nor replacement is possible

Reporting technical defects

The Buyer must report technical defects within 14 (fourteen) calendar days of receiving the confirmation email with the access links, by sending a notification to: hi@danblocks.com

The notification must contain:

  • The Buyer's identification details (first name, last name, the email address used for the order)
  • The order number and date
  • A detailed description of the defect found
  • Evidence of the defect (screenshots, error messages, etc.), if possible

Refunds for technical defects

If a refund is approved because of a technical defect that cannot be remedied, the Seller will return the amount paid within 14 (fourteen) calendar days of the approval date, by refunding it to the card used for the original payment.

The Buyer's responsibility

Any problems relating to the compatibility of the digital products purchased with the Buyer's equipment, software or operating system are not the Seller's responsibility, provided the minimum technical requirements were stated in the product description on the website.

The Buyer must check the technical requirements of the digital product before placing the order and make sure they have the equipment and software needed to use it.

VIII. PROPERTY RIGHTS

The content of the website, including but not limited to logos, stylised representations, trade symbols, still images, moving images, text and/or multimedia content presented on the Website, is the exclusive property of DTM GOES ONLINE SRL, which reserves all rights obtained in this respect directly or indirectly (through licences of use and/or publication).

The Client/User may not:

  • Copy, distribute, publish or transfer it to third parties
  • Modify and/or alter it
  • Use, link to or display it
  • Include any content in any context other than the one originally intended by DTM GOES ONLINE SRL
  • Include any content outside the website

Exception: with the express written consent of DTM GOES ONLINE SRL given before these operations.

Where DTM GOES ONLINE SRL grants the Client/User the right to use certain content, in the form described in a separate usage agreement, which they have or gain access to under that agreement, this right extends only to the content defined in the agreement, and only for as long as that content exists on the website or for the period defined in the agreement.

No content sent to the Client or User by any means of communication (electronic, telephone, etc.) or acquired by them by accessing, visiting and/or viewing constitutes a contractual obligation on the part of DTM GOES ONLINE SRL.

IX. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL FOR DIGITAL PRODUCTS

Legal basis

In accordance with Art.

Applicability to www.danblocks.com

Since the website www.danblocks.com sells exclusively digital products (templates, guides, online courses, digital resources and other similar materials supplied in electronic format), all the products sold fall under this legal exception.

Characteristics of the digital products sold

The digital products sold on the website:

  • (a) Are supplied on an intangible medium (electronic files accessible through download or online access links)
  • (b) Do not deteriorate or expire, being permanently available for download or access after purchase
  • (c) Have no stock limits, being permanently available for purchase
  • (d) Are delivered instantly by email, immediately after the payment is confirmed

How the right of withdrawal is lost

By completing the Order, the Buyer:

  • (a) gives express consent to the immediate supply of the digital content
  • (b) acknowledges that they lose the right of withdrawal from the moment they receive access to the digital product

Exception - Technical defects

Being unable to exercise the right of withdrawal does not affect the Buyer's rights in the event of technical defects in digital products (non-working links, corrupt files, missing or incomplete content), which are governed in detail in Section VII - The right of withdrawal for digital products, subsection “Exceptions - Technical defects”.

X. TERMINATION OF ONLINE SALES

The Seller has the right, at any time, to modify, suspend or end the online sale of Products and/or Services, partially or entirely, temporarily or permanently, with or without prior notice. Orders validly confirmed by the Seller before such modification, suspension or termination will be duly fulfilled by the Seller.
